AUSTRALIAN PREMIUM RATE SMS TERMS Your access to the mBill Services is conditional upon your acceptance and compliance with the terms, conditions, notices and disclaimers contained in this document (known collectively as "Terms of Use"). Your use of, and/or access to the mBill Services constitutes your agreement to the Terms of Use. mBill reserves the right to amend the Terms of Use at any time. Since you are bound by these Terms of Use, you should ensure that you have read and fully understood them. Your mobile telephone carrier supplies the carriage for the mBill Services to you. The charges for the carriage of all mBill Services will appear on your next mobile telephone bill. All queries relating to mobile telephone bills should be directed to your mobile telephone carrier. Charges for specific mBill Services are set out below. Under no circumstances (including but not limited to any act or omission on the part of mBill ) will mBill be liable for any indirect, incidental, special and/or consequential damages or loss of profits whatsoever which result from any use or access of, or any inability to use or access the mBill Services. Except as provided for by any non-excludable statutory right: a) all content for mBill Services are provided "as is" and without warranties of any kind, either express or implied, b) Your mobile telephone carrier, mBill and its suppliers expressly disclaim all warranties of any kind including but not limited to implied warranties of merchantability and fitness for a particular purpose, c) Neither your mobile telephone carrier, mBill warrants that access to the mBill Services will be available, uninterrupted, free from delay or error-free or that any defects will be corrected. Your mobile telephone carrier or mBill may terminate or discontinue in whole or in part any or all of the mBill Services at any time, for any reason. All information, text, material, graphics, software and advertisements contained in or forming the mBill Services ("Content") are the property of mBill , its suppliers and/or licensors (including your mobile telephone carrier) unless expressly indicated otherwise. The Content is protected by Australian and international copyright and trademark laws. You must not modify, copy, reproduce, republish, frame, upload to a third party, post, transmit or distribute this Content in any way. mBill is open to customers who are connected to the Telstra, Vodafone & Optus mobile digital networks and participating service providers with SMS compatible mobile phones. Additional Terms & Conditions The customer agrees that all mBill messages are charged on sending, including those messages: (a) sent to initially register for the service or to re-register following 'exit' from the service (b) not delivered or (c) ignored by the receiving mBill user. Customers of Telstra, Vodafone & Optus mobile digital networks and participating service providers with SMS compatible mobile phones. will be charged $3.95 per message pair. (including GST).
